Do you charge for an initial consultation?

No. B&H offers a 30 minute initial consultation for no charge. We would prefer to meet with you face to face to discuss your case, but in certain situations we are able to have the initial consultation over the phone.

Are payments plans available?

Yes. Before beginning any services, the attorney you meet with will discuss the fees associated with meeting your legal needs. At that time the attorney can work with you to establish the payment arrangement that ensures you are represented throughout your case.

What methods of payment do you accept?

B&H accepts cash, money order, debit card, Visa, Discover and Master Card. Additional usage fees may apply when using a credit card.

In which states do you practice?

B&H currently represents clients in both Missouri and Kansas.

What should I bring to the initial consultation?

You do not need to bring anything to your first meeting, but it may be helpful to bring any documentation associated with your legal issue to give the attorney a better understanding of your matter.

What counties do you serve?

In Missouri we serve the metro area including Clay, Jackson, and Platte counties. Our attorneys will travel outside of the metro area as needed.

In Kansas we serve Johnson and Wyandotte counties.

Dissolution of Marriage:

Do I need to hire an attorney to get divorced? I heard there are forms online?

While you can represent yourself and some forms are available online, there are many issues that often arise throughout the course of a dissolution that will have an impact on the outcome of your case. Without legal training and experience, these issues may be hard to identify. Additionally, not all forms found online are admissible in court.

What is the general time line for divorce?

The amount of time needed to complete the divorce process varies based on the complexity of each case and the unique issues your matter presents.

  • In Missouri, a Petition for Dissolution of Marriage must be on file with the Court for at least 30 days before a judgement can be entered.
  • In Kansas, a Petition for Divorce must be on file with the Court for 60 days before it can be finalized.
  • In both states, the opposing party must be given at least 10 days notice of a pending hearing, including the final hearing when the Judgment is entered. This 10 day notice period begins at the end of the 30 (Missouri) or 60 (Kansas) day waiting period described above.

Can my spouse and I have the same attorney?

No. One attorney cannot represent both a Husband and Wife in a dissolution of marriage. It is possible for one party to be represented by an attorney while the other party proceeds pro se (represents him or her self).

Do you review paperwork for pro se litigants?

Yes. B&H offers limited scope services such as reviewing paperwork legal documents, preparing documents on your behalf, including your final judgment, and attending the dispositional hearing.

Modification:

When can I modify child support?

A modification to the amount of child support that is paid or received can be modified at any time depending on the circumstances of the parties. You will need to speak to an attorney to determine if your unique set of facts would be enough for a modification.

Paternity:

Why do I need to start a paternity action?

A paternity action establishes the parental rights of unwed parents, including legal and physical custody of the child and child support.

There is no question who is the father of my child, do I still need a paternity action?

Yes. A paternity action will legally establish the parental rights of the father of a child born to unwed parents. A paternity action can establish custody and child support rights as well.

DUI:

I just got a DUI, when should I contact an attorney?

Immediately. In some cases the suspension of your driver’s license may be delayed or prevented all-together if you or your attorney follow the proper procedure. Failure to act within the short period of time allowed by law may prevent you from utilizing certain remedies.

What are the consequences of a DUI?
